Eviction Lawyer Fairbanks AK

The home must stay here on the property while our company is financing it. But if you evict for nonpayment of rent or continued guideline violations, the judge in our court says that if I want them out, then they can move the home. My finance company does not want that so who knows what to do to enforce anything around here?

A community manager recently contacted me with a major operations situation.   She felt she was facing major burn-out, felt she had no support from her supervisors, felt that no one really cared about her community other than her, and most importantly, felt that no one even knew how hard some of the corporate decisions made her life.

 

Let’s take a peek into her world from the eyes of the manager, and in her words.   “ I am having serious burn-out problems. I started with this community about a year ago.   Everyday here with the residents is a constant battle.   It is very difficult to get them to come in compliance with the community guidelines. They curse me out on a daily basis, make threats, and to tell you the truth, Chrissy, I sometimes am afraid of the reactions that I am going to get back when I try to enforce anything with some of them.

 

Another problem is that our company has its own finance company and we finance some of the homes in our communities. The problem is that with some of the people that we finance, it is hard to enforce guidelines.   Let’s face it, what am I going to do if they don't come into compliance?   What I mean is this: I can write them up as many as three times for the same issue, but they still don’t comply.   The finance company does not want me to evict because that is a repossession on the books for them, and it also goes against my goals for the year as far as the company is concerned.   I feel this is a catch-22 situation. The home must stay here on the property while our company is financing it. But if you evict for nonpayment of rent or continued guideline violations, the judge in our court says that if I want them out, then they can move the home.   My finance company does not want that so who knows what to do to enforce anything around here?   And, believe me, the residents know it, too !

 

Another thing I am told is:   ‘If you are having trouble with a guideline issue, sure, get them out of there as a last resort.’   However, they don’t want me to let the house go, and they always remind me that it will be another repossession to count against my manager’s goals for the year.   The other residents who do not have their homes financed by our company see this and want to know what the difference is between them and our customers.   The residents with outside financing obviously feel like we are picking on them as far as guideline issues are concerned.   I honestly don’t know what to tell them.

 

Another problem I have is that there is no maintenance staff, and this is a 189-site community.
